Terms of Service

1. These terms

By creating an account or using ViralMeme (the "Service", at https://viralmeme.ai), you agree to these Terms, our Privacy Policy and our Refund Policy. If you don't agree, please don't use the Service.

2. What ViralMeme is

ViralMeme tracks the memes spreading fastest and gives each one a page that explains it. For memes built around a photo, you can put yourself in it: upload one photo of yourself, or two (you and a partner, a parent, a friend or a pet), and choose an image or a short video. An AI model then recreates the meme's format with you in it.

• Images and videos are made by AI models run by SeeAPI (fal is a backup for images).
• Automated filters check your photos and finished videos. A photo flagged when you tap Make is refused before any credits are spent. A video flagged when it finishes is withheld, and its credits come back.
• We may change the AI models we use. If a video model is down, we may use a comparable one at the same credit cost.
• Some features may be paused or limited while we test them.

3. Meme pages

• Meme pages are our own explanations, written from the sources listed on each page. We try to get every fact right, but a page can be wrong or out of date. Tell us and we will fix it.
• Meme names, original posts, clips and sounds belong to their creators. Where we found it, a meme page shows the original picture as it spread, labelled "The original", credited and linked to the page that carries it, and never presented as ours. We take it down when its owner asks (see Contact). Everything else we link to rather than copy.
• We recreate the format, never the original post. Results never reuse the original image or clip, and never add a real person other than the people in your photos. A meme about a real person, or built on someone else's character, is explained, not made.
• Examples on meme pages are made from AI-generated people and marked as AI examples.

4. Accounts

• Signing in is free. You can sign in with your email, or with Google where it is offered. Keep your login safe; you are responsible for what happens under your account.
• You must be at least 13 years old (or the higher minimum age where you live).
• Don't open several accounts to get around limits. We may block those attempts and close the accounts.

5. Your photos

This matters most. By uploading a photo, you confirm that:

• it shows you, or someone who agreed to have their photo used this way. Never upload someone else's photo without their consent;
• it does not show a celebrity, politician, creator or other public figure as the subject;
• if it shows a child, you are their parent or guardian or have a parent's or guardian's permission, and the result will never put the child in a sexual, violent or otherwise unsafe context;
• you have the right to use it.

6. What you may not make

Don't use the Service to make or share:

• sexual content, or anything sexualizing a minor or someone who looks like a minor. No exceptions;
• content that harasses, bullies, threatens or humiliates someone, or attacks people for who they are;
• content that impersonates someone, or that is meant to deceive, such as passing a result off as real footage of a real person;
• anything illegal, or anything that infringes someone else's copyright, trademark, privacy or publicity rights.

Also don't try to get around our safety filters, limits or payments, and don't scrape, overload or interfere with the Service. We may refuse a make, remove content, and suspend or close accounts that break these rules. Credits already spent are not returned in that case.

7. Credits and payment

• Every make is paid with credits. An image costs 5 credits and a video costs 10. The cost is shown on the button before you make anything.
• You buy credits in one-time packs or with a monthly or yearly plan, through Stripe's checkout. Prices are on the Pricing page. Prices and offers may change, and different visitors may see different offers; the price shown at checkout applies.
• Pack credits never expire.
• Plans renew automatically until you cancel. By subscribing, you allow us (through Stripe) to charge your payment method at the start of each billing period. Each period's credits are added when it is paid (a yearly plan adds the whole year's at once) and expire when that period ends. Unused plan credits don't roll over.
• All your credits share one balance. The credits that expire soonest are used first.
• Cancel any time in Settings → Billing. Cancelling stops all future charges right away. Credits already added for the current period stay until that period ends. We don't give prorated refunds, except as the Refund Policy says.
• A make that fails is never charged. If it errors, times out, or is withheld by a safety check, the credits come back automatically. A make that works but that you don't like is not a failure.
• Credits we give for free have no cash value and can't be refunded.
• Credits can't be sold, transferred or exchanged for cash, except through gift links when we offer them, and as the Refund Policy says.

8. Your content and your results

• Your photos stay yours. You give us permission to store and process them only to run the Service: to make what you ask for and to check it for safety. We don't use them to train our own models.
• Results are made by AI. They can look real. Don't present them as real footage, and label them as AI where a platform asks you to. You are responsible for how you share them.
• Subject to these Terms and to other people's rights (including the people shown and the creators of the meme), you may use your results for personal and commercial purposes.
• AI can give similar results to different people, so we can't promise yours is unique.
• Your results stay private unless you share them. They are saved in Me. If you tap Copy link, anyone with that link can see that one result (the page is kept out of search engines). If you post it to the Feed, it appears there after our review, credited only as "a ViralMeme user".
• By posting a result to the Feed you let us show it on ViralMeme until you take it off, which you can do at any time from the result. We may refuse or remove any post, and posts that several people report are hidden until we review them.
• You can ask us to delete your results at any time.

9. Availability

We run the Service on a best-effort basis. We don't promise it will always be available, how fast a make will be ready, or that a meme, model or feature will stay on offer.

10. Ending your use

You can stop using the Service and ask us to delete your account at any time. We may suspend or close accounts that break these Terms, abuse limits or offers, make fraudulent chargebacks, or put the Service, other users or people shown in content at risk. Sections 5, 6, 8 and 11 still apply after an account ends.

11. Disclaimers and limits of liability

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. To the fullest extent the law allows, our total liability for anything arising from the Service is limited to what you paid us in the 12 months before the claim, and we are not liable for indirect, incidental or consequential damages. Nothing here limits liability that the law does not allow us to limit.

12. Changes to these terms

We may update these Terms. The date at the top shows the latest version, and we will announce important changes on the site. If you keep using the Service after a change takes effect, you accept the new Terms.
